pumped every 2-3 years. Why do you say that your design
cycle is 12 years and you recommend a 7-10 clean-out cycle? |

If
the municipality is responsible for maintaining my clarifier
is there an easement to get access to my tank/laterals?
Easement rules
will vary by location but many areas will already have some
pre-existing legislation that will generally allow for tanks
and lateral access. For
example, in the province of Ontario it is defined through
the Municipal Act 2001, under s.80, which provides for entry
on land with regards to public utilities as defined in s.11.
The Act also specifically provides for entry on land regarding
sewage systems (in s.87). Access to the tanks may also be
provided by delineated easements or by a sewer area bylaw
that describes ownership and access by the Municipality.
The Planning Act, s.41 defines the provision of easements
with respect to public utilities. In new subdivisions, specific
references to system access and maintenance can be provided
and enforced through the registered subdivision agreement. |
